Legal Profession Regulations
The following legal profession regulations apply:

  • Federal German Legal Code of Practice (BRAO)
  • Professional Code of Practice (BORA)
  • Specialist Attorneys’ Act (FAO)
  • Attorneys‘ Scale of Remuneration Fees (RVG)
  • Council of Bars and Law Societies of Europe Code of Conduct (CCBE)

Professional Community and Measures for the Avoidance of Conflicts of Interest
The partners listed above have affiliated in the form of a professional partnership with limited professional liability (Partnerschaftsgesellschaft mbB) for the purpose of sustained exercise of their profession.

Representation of conflicting interests is forbidden to legal attorneys on the basis of their professional regulations (Sec. 43a Para. 4 BRAO). Prior to accepting a brief therefore a check is always made as to whether any conflict of interest exists.


Contractual Clauses regarding Governing Law and Legal Venue applying to Contracts with us
In client and fees agreements, in particular with foreign clients, as a matter of principle we apply the following contractual clauses in this regard:

Governing Law:
“In respect of this Agreement the question of its conclusion and all claims arising from or in connection with this Agreement the laws of the Federal Republic of Germany shall apply as they would between citizens of that country.”

Legal Venue:
“Legal venue for all disputes arising from or in connection with this Agreement – including after termination thereof – shall be Düsseldorf, if the client is a businessman or public law legal person or is a public law separate estate or has no general legal venue in the Federal Republic of Germany. The said legal venue is exclusive for all client legal actions against Rellermeyer + Partner and for all Rellermeyer + Partner legal actions against the client it shall optionally apply in addition to all other statutory legal venues.”


Professional Liability Insurance
Professional liability insurance is maintained with ALLCURA Versicherungs-AG in Hamburg. The geographical area of application of insurance cover includes activity in the member states of the European Union and thus meets at least the requirements of Sec. 51 of the Federal German Legal Code of Practice (BRAO).


Out-of-Court Settlement
In the event of disputes between attorneys and their clients there is available on request the option of out-of-court settlement via the Düsseldorf Regional Bar Association (pursuant to Sec. 73 Para. 2 (3) in conjunction with Sec. 73 Para. 5 BRAO) or via the Legal Attorneys’ Arbitration Board (Sec. 191 f. BRAO) which is established at the Federal German Bar Association and which can be found on the Internet via the latters home page (www.s-d-r.org).
